The Special Prosecutor’s January 6 Case is threatened.
Jack Smith can artfully steer the prosecution of Donald Trump’s alleged conspiracy to interfere in the transfer of power.
He can’t, however, stop the clock.
The Supreme Court is a busy place these days, hearing cases it shouldn’t be hearing, and dismissing or simply punting those cases it should be hearing. (2)
The current “absolute immunity” case is an example. Why is the US Supreme Court hearing it? Before we deep dive into answering that question, pause and consider that it’s a dice roll that even before oral arguments began April 25, the J6 election interference case decision would see the light of day before November.
According to excellent reporting by Adam Liptak (3), it’s moot whether the future J6 interference case, delayed and dumbed down, will be perceived by the public to matter at all. This possibility is the biggest win for the Trump legal team: to reduce the case to so many “pieces of paper,” echoing their defense opening statement in the election financing violation case on Monday in New York.
